If your clinic is a HIPAA covered entity, patient details collected through your booking app or website are generally protected health information. Every vendor that stores or processes that data for you, including your developer, host and reminder service, is usually a business associate. Each one needs a signed Business Associate Agreement before launch.

This article is general information, not legal advice. HIPAA compliance is your clinic's responsibility. Confirm decisions with your own compliance and legal advisers.

I run a small web and app studio. Clinic owners often ask me one question first: "Is your booking app HIPAA compliant?" No developer can honestly answer that alone. HIPAA compliance depends on how your clinic uses the software, who it shares data with and what contracts are in place. Here is what to understand before you hire anyone.

Does HIPAA apply to my clinic's booking app or website?

It applies if your clinic is a covered entity. HHS defines three types: health plans, health care clearinghouses and certain health care providers.

A provider is covered if it transmits health information electronically in connection with a standard transaction. In practice, that usually means billing insurance electronically. Most clinics that accept insurance fall into this group.

When a covered entity hires another company to help with its health care functions, HHS says it must have a written business associate contract. HHS also notes that business associates are directly liable for parts of the HIPAA Rules.

If your app is not offered by or for a covered entity, HIPAA may not apply. The FTC's rules may apply instead. More on that below.

What counts as patient data in a booking flow?

Treat almost everything a patient enters as protected health information (PHI). HHS's tracking guidance says information collected through a regulated entity's mobile app generally is PHI. It also says logged-in pages, such as patient portals, generally have access to PHI.

A booking flow typically collects a name, phone number, email, chosen provider, visit reason and appointment time. Linked together, these describe a person's care. Design as if all of it is protected.

When does a developer or vendor need a Business Associate Agreement?

A vendor needs a BAA when it creates, receives, maintains or transmits PHI on your behalf. HHS's cloud guidance is direct on this. A cloud provider that stores your ePHI is a business associate. That holds "even if the CSP processes or stores only encrypted ePHI and lacks an encryption key for the data."

The same guidance says the "conduit" exception is limited to transmission-only services. A vendor that stores data does not qualify. HHS also says a vendor is a business associate whether or not a BAA is signed. A signed BAA is necessary, but it is not sufficient on its own.

If your developer will access live patient data, through admin access or support work, they likely need a BAA too. Many clinics avoid this by keeping developers on test data only.

ComponentHandles PHI?What to check / BAA needed?
Booking formYes, once a patient submits detailsWhere submissions go. Avoid plain email delivery and third-party form tools without a BAA.
Scheduling softwareYesVendor must sign a BAA. Check access roles, audit logs and data export.
Hosting / cloud databaseYes, even if encryptedBAA required, per HHS cloud guidance. Confirm which services the BAA covers.
Email / SMS remindersOften, if message content or contact lists link patients to careBAA with the messaging vendor. Keep reminder text minimal.
Analytics and ad pixelsPossibly, especially on logged-in pages and in appsVendor generally needs a BAA if it receives PHI. Otherwise remove it or get patient authorization.
App store listingThe listing itself, no. The app behind it, yesPrivacy policy, Google Play Health apps declaration and Apple health data rules.

What does the HIPAA Security Rule expect from the software?

The Security Rule requires covered entities and business associates to protect the confidentiality, integrity and availability of electronic PHI. It is technology neutral. HHS says it "does not dictate the specific security measures" you must use.

In plain terms, it asks for three groups of safeguards:

  • Administrative: a documented risk analysis, a named security official, staff training, incident procedures, backups and business associate contracts.
  • Physical: control over who can reach devices, workstations and storage media.
  • Technical: access control, audit controls, integrity protection and transmission security.

For a booking app, that translates into role-based logins, logs of who viewed or changed records, encrypted connections and tested backups. HHS also stresses that "addressable" does not mean optional. If you skip an addressable item, you must document why and what you use instead.

Can I use analytics or ad pixels on my booking pages?

Be very careful. HHS's guidance on online tracking technologies says tracking tools on logged-in pages and in clinic apps can access PHI. A tracking vendor that receives PHI is generally a business associate. If a vendor will not sign a BAA, you generally need patient authorization before disclosing PHI to it.

In June 2024, a federal court in Texas vacated part of that guidance. The vacated part covered certain tracking on public, unauthenticated pages. HHS's page now carries a note about the order. The rest of the guidance, including the parts on logged-in pages and apps, still stands.

My practical advice: keep ad pixels off booking forms, confirmation pages, portals and apps. Use analytics that you can configure tightly, under a BAA, or none at all.

What do Apple, Google and the FTC require?

Apple. App Store Review Guideline 5.1.3 restricts using health data for advertising or data mining. It also says apps "may not store personal health information in iCloud." Every app needs an accessible privacy policy. Apps that let users create accounts must also let them delete accounts in the app.

Google Play. All published apps must complete the Health apps declaration in Play Console. Appointment booking falls under "Healthcare Services and Management," described as "for scheduling medical appointments, reminders, telehealth services."

FTC. The FTC's Health Breach Notification Rule covers many health apps and websites that HIPAA does not. It does not apply to HIPAA covered entities. Amendments took effect on July 29, 2024. The FTC says violations can bring penalties of up to $51,744 each. If you sell a booking tool to clinics, or run one outside HIPAA, read this rule.

What should I check before launch?

  1. Confirm with your advisers whether your clinic is a covered entity.
  2. List every vendor that will touch patient data, from host to SMS provider.
  3. Sign a BAA with each vendor that stores or processes PHI.
  4. Complete or update your Security Rule risk analysis to include the new app.
  5. Set role-based access for front desk, clinicians and admins.
  6. Turn on audit logs and confirm someone will review them.
  7. Encrypt data in transit and at rest, and test backup restores.
  8. Remove ad pixels from booking, confirmation and logged-in pages.
  9. Publish a privacy policy that matches what the app actually does.
  10. Add consent capture and an in-app account deletion flow.
  11. Complete Google Play's Health apps declaration and review Apple guideline 5.1.3.
  12. Keep developers on test data, or put a BAA in place before granting access.

Our healthcare build experience

Digital Architect has built healthcare software in India. We built the Bharosa mental-health platform for a hospital group: a patient app, doctor app and care portal, with 350+ screens. The patient app reached the App Store and Google Play in 10 weeks. It includes doctor discovery, real-time slots, booking and an anonymous counsellor chat. Read the Bharosa case study. We build booking systems and portals with role-based access, audit logs, encryption, and consent and deletion flows. We also run 10 live healthcare websites. That work was under Indian requirements, not HIPAA. For a US clinic, we build to your advisers' requirements and your vendors' BAAs.

Frequently asked questions

Does a booking form need to be HIPAA compliant?

HIPAA applies to your clinic and its business associates, not to a form by itself. If you are a covered entity, data submitted through the form is generally PHI. Every tool that receives it, including form builders, email and hosting, needs proper safeguards and usually a BAA.

Does my developer need to sign a Business Associate Agreement?

Yes, if they will create, receive, maintain or transmit PHI for you. That includes hosting your database or accessing live records for support. A developer who works only with test data and never touches PHI may not need one. Confirm with your advisers.

Can a developer outside the US build a HIPAA booking app?

Yes. HIPAA does not ban offshore vendors. HHS's cloud guidance notes that risks to ePHI "may vary greatly depending on its geographic location." Include vendor location in your risk analysis. Keep production data in US hosting under a BAA, and limit offshore access to test data where possible.

Can I use Google Analytics or the Meta Pixel on my booking page?

Generally, avoid them on booking, confirmation and logged-in pages. HHS guidance says tracking vendors that receive PHI are generally business associates. If they will not sign a BAA, you would generally need patient authorization. A 2024 court ruling narrowed only the public-page portion.
